What is being Negotiated?

A treaty is being negotiated between the Ktunaxa Nation, Canada and B.C. on a government to government basis.

The Ktunaxa Nation is approaching treaty negotiations based on our view of the Four Pillars of a Nation: Lands & Resources, Economic, Culture & Language, and Governance.

Based on the Four Pillars of a Nation, here are examples of some of the issues being negotiated at the treaty table by the Ktunaxa Nation, Canada and B.C.:

Lands and Resources
This area will define all aspects of the Ktunaxa relationship to land within the Ktunaxa Traditional Territory.

	Recognition of Ktunaxa aboriginal rights and title.
	Ktunaxa Nation land base (Ktunaxa government lands).
	Ktunaxa government jurisdiction on our lands (law-making).
	Ktunaxa ownership and management of resources on our lands.
	Access granted to the three governments on each others’ lands (Ktunaxa, provincial and federal government lands within the Ktunaxa Traditional Territory).

Economic
This area will define the money transfers and future economic relationships between the Ktunaxa Nation and the governments of B.C. and Canada.

	One-time payment upon signing of a treaty.
	Government transfer mechanisms.
	Resource-revenue sharing.
	Taxation arrangements.

Culture & Language
This area will define what control the Ktunaxa Nation will have over the culture and welfare of Ktunaxa people.

	Ktunaxa management of social programming (education, health, child welfare).
	Ktunaxa control over traditional and cultural resources.
	Social equity in terms of wellness.

Governance
This area will define all aspects of the future Ktunaxa government.

	Ktunaxa government structure.
	Defining Ktunaxa citizenship.
	Ktunaxa government law-making power and processes.
	Government to government relationships.
	Justice.

Treaty Provisions
The negotiations also address a fifth area - Treaty Provisions - which captures ways to make the treaty a “living document” and bring the words off the pages into action.

	Treaty ratification.
	Treaty implementation.
	Amendment procedures.
	Dispute resolution.
